This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit nexusgrowth.ai (the "Site"), submit a form, communicate with us by phone or SMS, or otherwise engage with our marketing and advertising services (collectively, the "Services").

By using the Site or Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or Services.

• Phone number (mobile and/or landline)

• Service category, monthly revenue range, and other qualification information you submit through forms on our Site
• Any other information you choose to provide in messages, calls, or forms

• Pages visited, referring URLs, time spent on pages

3. SMS / Text Messaging Program

3.1 Consent

When you provide your mobile phone number through a form on our Site and check the SMS consent box, you expressly consent to receive text messages from Nexus Growth at the number you provided. Your consent is not a condition of purchase. Consent is specific to Nexus Growth and is not transferable or assignable to any other sender.

3.2 Types of Messages You May Receive

• Appointment confirmations and reschedule links
• Follow-ups regarding your inquiry or strategy call
• Account, billing, and service updates (for active clients)
• Customer care responses

Message frequency varies based on your interactions with us.

3.5 Opt-Out (STOP)

You can cancel SMS messages at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive from us. After you send an opt-out keyword, we will send you a one-time confirmation message and will not send you additional SMS messages, except as required to complete or confirm an active transaction. If you want to receive messages again, you may sign up as you did the first time.

3.6 Help (HELP)

For help, reply HELP to any message, or contact us at landon@nexusgrowth.ai. We will respond with instructions on how to use the service and how to opt out.

3.7 Carrier Disclaimer

Carriers (including but not limited to AT&T, T-Mobile, Verizon, Sprint, and U.S. Cellular) are not liable for delayed or undelivered messages.

3.8 Supported Carriers

Our SMS program is supported by all major U.S. carriers.

3.9 No Sharing of Mobile Information for Marketing or Promotional Purposes

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories listed in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

This means: phone numbers and SMS opt-in data collected on this Site will never be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Phone numbers and SMS consent records are used only by Nexus Growth to communicate directly with you, and are disclosed only to the SMS service providers strictly necessary to deliver messages on our behalf (such as our messaging platform and underlying carriers).

4. How We Share Information (Non-SMS Data)

We do not sell your personal information. We may share information collected through the Site (excluding SMS opt-in data, which is governed by Section 3.9) with the following categories of recipients:

• Service providers who help us operate our business, such as hosting providers (Vercel), database providers (Supabase), payment processors (Stripe), email providers (Resend), CRM and task management (ClickUp), analytics providers, and advertising platforms (Google, Meta) — solely to perform services on our behalf and under contractual confidentiality obligations.
• Professional advisors such as lawyers, accountants, and auditors, where necessary.
• Legal and regulatory authorities when required by law, subpoena, or to protect our legal rights.
• In connection with a business transaction such as a merger, acquisition, or sale of assets, subject to standard confidentiality protections.

Phone numbers and SMS consent data are excluded from all of the above sharing for marketing or promotional purposes.

5. Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce agreements. Specifically:

• SMS opt-in records and opt-out records: retained for at least the period required by applicable law. For Virginia residents, opt-out records are retained for 10 years in accordance with Virginia SB 1339.
• Lead and prospect data: retained for up to 3 years from last interaction, unless a longer period is required by law.
• Client account data: retained for the duration of the engagement and for 7 years thereafter for tax and audit purposes.

6. Your Rights and Choices

Depending on where you live, you may have the following rights:

• Access: request a copy of the personal information we hold about you.
• Correction: request that we correct inaccurate information.
• Deletion: request that we delete your personal information, subject to legal retention requirements.
• Opt out of marketing: unsubscribe from marketing emails using the link in any email, or reply STOP to opt out of SMS at any time.
• Do Not Sell or Share (California, etc.): we do not sell personal information.
• Portability: request a portable copy of your information.
• Withdraw consent: withdraw consent for processing where consent is the legal basis.

7. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS/HTTPS), access controls, and secure cloud infrastructure (Supabase, Vercel). No method of transmission over the Internet or method of electronic storage is 100% secure, however, and we cannot guarantee absolute security.

8. Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies to operate the Site, analyze usage, and support advertising. This includes Google Analytics, Google Ads, and Meta (Facebook) Pixel. You can control cookies through your browser settings. Disabling cookies may affect Site functionality.

9. Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

10. Children's Privacy

The Site and Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us at landon@nexusgrowth.ai and we will delete it.

11. International Users

The Site is operated in the United States and intended for U.S. users. If you access the Site from outside the United States, you understand and consent to the transfer of your information to and processing in the United States, which may have different data protection laws than your country.

12. State-Specific Disclosures

California Residents (CCPA/CPRA): You have the right to know, delete, correct, and opt out of "sale" or "sharing" of personal information. We do not sell or share personal information for cross-context behavioral advertising as defined under the CPRA. To exercise rights, email landon@nexusgrowth.ai.

Virginia Residents (VCDPA / SB 1339): You have rights to access, correct, delete, and opt out of targeted advertising and the sale of personal data. We retain SMS opt-out records for 10 years as required by Virginia law.

Other State Residents: Residents of Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive privacy laws may have similar rights. Contact landon@nexusgrowth.ai to exercise them.

13. Governing Law

This Privacy Policy is governed by the laws of the State of Indiana, without regard to its conflict of laws principles. Any disputes arising from this Privacy Policy will be resolved in the state or federal courts located in Indiana.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will notify you by email or by posting a prominent notice on the Site. Your continued use of the Site or Services after changes become effective constitutes acceptance of the updated Privacy Policy.
